Apportionment of the RENT-CHARGE in lieu of TITHES in the Parish of Bampton In the County of Westmorland.
Whereas an Agreement for the Commutation of Tithes in the Parish of Bampton
County of Westmorland was, on the fifteenth day of February in the Year One Thousand and Thirty nine, confirmed by the Tithe
Commissioners for England and Wales, of which Agreement, with the Schedule there compris, the following is a Copy:-
Provisional articles of Agreement for the Commutation of the Tithes of the Parish of Bampton in the County of Westmorland pursuant to the Act of Commutation of Tithes in England and Wales made
and executed at a Meeting of the Landowners and Tithe owners of the said Parish duly called and holden in the Parish and adjourned from time to time and holden
by adjournment in the eighth day of March One thousand eight hundred and thirty eight and since perfected. By and Between the several owners of Lands
within the said Parish by whom or by whose Agents duly authorized in That behalf This Agreement is executed and the interest of which landowners in the lands
within the said Parish is not less than two thirds of the lands therein subject to tithes of the one part and the Right Honourable William Earl of Lonsdale KG the Trustees of the
Free Grammar School of Bampton and the Reverend William Hodgson Clerk Vicar of the said Parish. Improprietors and owners of all the Tenths or Tithes
whatsoever yearly arising within the said Parish of the other.
The said Parish of Bampton contains by estimation 3678a.3r.10p of Land Statute Measure (exclusive of Common or Waste Lands).
The Whole of which except as hereinafter mentioned is subject to the Payment of Tithes as well great as small.
The estimated Quantity of land subject to Tithes within the said Parish is 3464a.1r.23p Statute Measure.
The undermentioned Lands of the said Parish have been from time immemorial exempt from the payment of the undermentioned tithes (that is to say
A certain Estate called Thornthwaite Halle containing by estimation 214a.1r.27p Statute Measure of which the Earl of Lonsdale is owner and John Abbott occupier is by
prescription absolutely exempt from the payment of all tithes as well Great as small except one field by estimation 3a.1r.1p known by the name of Reynold Croft which is
chargeable with Tithe Corn to the Trustees of Bampton School but the Vicar is entitled to four Cattle Gates from May Day to Michealmas over the said Thornethwaite Hall Estate.
The Glebe Lands known by the names of the Vicar’s Acre and Vicar’s Garth and containing by estimation 2a.2r.28p are absolutely exempt from the
payment of tithes as well Great as small.
Certain Lands in Heltondale known by the names of Home Field, Corn Gaith Hill, Hay Close, InnWaite and Nursery containing by estimation 10a.0r.11p and of which
John Mounsey is occupier and owner are by prescription absolutely exempt from the payment of the Tithes of Corn, Grain and Hay.
Certain Lands in Heltondale known by the names of Meadow, Great Field, Little Intack, Great Intack, High Grassing, Planting, Low Grassing and Meadow Head containing
by estimation 19a.2r.25p and of which Richard Dufton is owner and occupier are by prescription absolutely exempt from the payment of Tithes of Corn Grain and Hay.
Certain Lands at Littlewater known by the names of High and Low Craggs containing by estimation 9a.0r.0p and of which Johnathon Rowlandson is owner and occupier
are by prescription absolutely exempt from the payment of the Tithes of Corn, Grain and Hay.
Certain Lands at Littlewater known by the names of Eastward, Eastward Nursery, Birks, Bramah Close and Birks Bottom containing by estimation 20a.3r.28p and of which
Thomas Holme of Barnskew is the owner and John Simpson occupier are by prescription absolutely exempt from the payment of the Tithes of Corn, Grain and Hay.
All the Lands within that part of the Parish known by the name of the Township of Knipe are by prescription absolutely exempt from the payment of the tithes of Hay.
Certain Lands known by the name of Risebarrow containing by estimation 31a.2r.34p are by prescription absolutely exempt from the payment of the tithe of Hay.
All other the Lands and Estates belonging to the said Earl of Lonsdale within the Parish are by prescription exempt from the payment of All Tithes as well Great as small except that part
thereof which is subject to the payment of Corn Tithe to the said Trustees of Bampton School Save and also except certain small tithes of Customary payments herinafter mentioned as payable to the said vicar of Bampton.
The following Moduses and prescriptive or Customary payments are payable in lieu of the following tithes throughout the titheable parts of the said Parish.
To the said William Earl of Lonsdale the sum of six shillings and five pence halfpenny yearly and every year in lieu of the tithes of Corn and Grain and Hay of Certain
lands in the Bampton side of Mardale and contaniing by estimation 147a.2r.10p Statute Measure.
To the said William Earl of Lonsdale the sum of eight shillings and four pence yearly and every year in lieu of the tithes of Corn and Grain and Hay of Certain
lands in Measand containing by estimation 189a.0r.1p Statute Measure
To the said William Earl of Lonsdale the sum of one shilling and tenpence halfpenny yearly and every year in lieu of the tithes of Hay and Corn and Grain of Certain Lands
known by the names og High Bramer, Calf Garth, Low Calf Garth, Meadow Close, Low Bramer, Broad Wardus, Seal Garth, Stubbons, Seale Close, High Side of Lane and Nursery’
Lane adjoining House, Hoghouse Close, Plantation, Back of Barn, Orchard, Cherry Croft and Plantation containing by estimation 47a.1r.14p Statute Measure and also in lieu of the tithe of Hay
of Certain other lands known by the names of Sunny Bank, Bowman Bank, Rash, Peggy Field and Ann Field containing by estimation 3a.2r.7p Statute Measure of which Thomas Mounsey is owner and occupier.
To the said William Earl of Lonsdale the sum of eight pence yearly and every year in lieu of the tithes of Corn and Grain and Hay of certain Lands Known by the names of Little Close
Bog Stubble Close, High Stubble Close and Waste containing by estimation 10a.0r.25p Statute Measure and of which Matthew Thompson if the owner and occupier.
To the said William Earl of Lonsdale the sum of eight pence yearly and every year in lieu of the tithes of Corn and Grain and Hay of certain lands Known by the names of Mealbarows
Low field and beckside containing by estimation 10a.3r.14p Statute Measure and of which John Stephenson is the owner and William Stephenson the occupier.
To the said Trustees of Bampton School the sum of One Pound three shillings and four pence yearly and every year in lieu of the tithe Hay of Certain Lands Known by the
name of Canon Ing containing by estimation 46a.2r.16p Statute Measure.
To the said Vicar throughout the titheable part of the said Parish three pence for every new calved cow, two pence for every new calved Heifer, one shilling and eight pence for every five
Calves two shillings for six, three shillings and one penny for seven, three shillings and two pence for eight, three shillings and three pence for nine, three shillings and four pence for ten. One
penny for each strip, Milch cow or Heifer, one penny for every foal, one penny for Garden, one halfpenny for each odd lamb, four shillings for a Pig, two shillings and three pence for a Goose
one penny for plough, two eggs for every hen, one egg for every chicken, two Eggs for every duck and the tithe of Honey and Bees Wax.
The said Earl of Lonsdale is Impropriator and owner of all the tenths of tithes of the titheable part of the said Parish except the tithes of Corn Grain and Sheaves of Corn receiving in
Bamptonfield, Gowray, Risebarrow, Grange Holmes, Bonbey Crofts, Fitts Walmgate, Littlewater, Drybarrows, Richard Gibsons and Richard Hogarths Crofts with the tithe Hay of
Canon Ing (of which the Trustees of Bampton School are the Impropriators and Owners) and certain other small tithes or customary payments as hereinbeforementioned and payable to
the said Vicar of Bampton.
And it is hereby agreed that the annual sum of one hundred and sixty four pounds by way of Rent Charges (subject to the Provisions of
the said rent) shall be paid to the said Earl of Lonsdale his heirs or assigns instead of all the tithes as well Great as small of the lands of the Parish subject to the
payment of tithes to the said Earl (including the Common or Waste Land) and instead of all Moduses or Customary payments payable in lieu thereof of which last
mentioned sum ten pounds and ten shillings shall be apportioned over the titheable lands in the township or Division of KNipe in lieu of the Corn tithe thereof..
And it is further agreed that the Annual sum of Fifty four pounds and eight shillings by way of Rent Charges, subject to the Provisions of the said Act
Shall be paid to the Trustees of Bampton School instead of the Corn tithes and prescriptive or Customary payment hereinbefore mentioned as payable to the said Trustees in respect
of the Lands of the said Parish subject thereto.
And it is further agreed that the annual sum of nineteen pounds and sixteen shillings by way of Rent Charge (subject to the provisions of the said
Act) shall be paid to the said William Hodgson as Vicar of the said Parish and Successors instead of the small tithes, Moduses and prescriptive or Customary
payments hereinbefore mentioned as payable to the said Vicar in respect of the lands within the said Parish subject thereto but not including the four Cattle Gates
hereinbefore mentioned the right to which is not to be affected by this Agreement.
In Witness whereof the said Parties to the presents of their agents duly authorized in their names and on their behalf have hereunto
subscribed and set their hands and seals at the place and time abovementioned.
Now We Thomas Mounsey of Butterwick Cragg and John Docker of Carhullan both in the Parish of Bampton
in the County of Westmorland
having been duly appointed Valuers to apportion the total Sum agreed to be paid by way of Rent Charge in lieu of Tithes, Amongst the several Lands
of the said Parish of Bampton.
Do Hereby apportion the Rent Charge as follows:-
